Board of Managers of the 72 Poplar Street Condominium highlights the legal risks associations face when governing documents are unclear or board members can't establish with documents that they upheld their fiduciary duties. Conflicting bylaws and a lack of precision and documentation led to a lawsuit alleging breach of contract, breach of fiduciary duty, and fraud.
