Companies trying to hire abroad without the appropriate knowledge, cultural research and legal/compliance platform… please don’t. You can’t simply apply your US laws to countries like Colombia, Argentina, or Mexico (yes, they’re different countries). Why? ➡️ You open the door for potential legal liability. You may think that’s super unlikely to happen, till it does. ➡️ Your employer brand loses credibility. Even if not facing direct compliance issues, you could face reputational ones and get viral the wrong way really quickly. ➡️ Even for contractor agreements, some clauses could make perfect sense to the US legislation you operate in. However, that could be totally out of place for the independent contractor you’re trying to sign off — let alone employees. Many companies can help you out in staying compliant and informed. Do your research and do things the right way. And even when legally compliant, you are to be culturally aware and trained to lead the diverse workforce you are bringing in. Not doing so, in my opinion, can also result in a violent, digital process of acculturation. As said by Voltaire: “History never repeats itself. Question of the Week: What is a Home Office compliance visit? This week’s question came from a client who wished to know more about Home Office sponsor compliance visits - what they are and how to be prepared for one. 🙋♀️ What are a sponsor’s duties? When an organisation is granted a sponsor licence, the Home office expects a high level of compliance with its sponsor duties and compliance policy. This expectation is normally fulfilled through adhering to the Home Office’s reporting and record keeping requirements, strict compliance with immigration and wider UK laws, and ensuring behaviour is conducive to the public good. 🧢 Sponsor compliance visits Home Office compliance officers will primarily assess whether an existing sponsor is meeting its sponsorship duties and complying with its obligation to prevent illegal working (by conducting timely and correct right to work checks on all employees). A compliance visit to a prospective sponsor will primarily assess whether an organisation has provided accurate information on its sponsor licence application and assess whether a prospective sponsor has the procedures and systems in place to meet Home office expectations. ⏰ When to expect a compliance visit Compliance visits can be carried out at any time, so it is essential to always be prepared for one. Visits can take place at the premises of licensed sponsors (or any site utilised by a sponsor for business activities) or through digital compliance inspections. Since the Coronavirus pandemic, there has been an increase in digital audit requests. From April 2022, digital compliance inspections can be undertaken using remote conferencing facilities and can involve a sponsor providing evidence prior to, during, or after a scheduled interview. 👨💻 Being prepared We have seen an increase in compliance visits to clients recently. Have you been successfully granted a Sponsor Licence for your business? Congratulations! However, the journey doesn't end here. Maintaining your Sponsor Licence at an A-rating is the key, and this comes with adhering to the UKVI’s regulatory obligations. Here's a top ten to-do checklist to help you refresh your understanding of your obligations as a Sponsor Licence holder and ensure your business remains compliant with the UKVI's requirements. 1. Assign roles and responsibilities to manage the Sponsor Management System (SMS) and ensure compliance. 2. Maintain accurate records of your sponsored employees, including contact details, immigration status, job descriptions, and any changes in circumstances. Keep records up-to-date and accessible for inspection. 3. Report changes promptly to the Home Office, such as changes in job title, salary, or work location, within the required timeframes using the SMS. 4. Conduct proper right to work checks on all employees, including sponsored workers, and keep copies of relevant documents. 5. Monitor sponsored employees' attendance and absences, and report any prolonged or unauthorised absences to the Home Office. 6. Comply with record-keeping duties, maintaining all documents related to sponsor duties, such as recruitment practices, job adverts, and employee records. Be prepared to provide them to the Home Office upon request. 7. Stay informed about changes to immigration rules and sponsor guidance, ensuring your policies and procedures reflect these changes. 8. Cooperate with the Home Office during potential compliance visits and fully cooperate with any requests for information or documentation. 9. Provide regular training to staff involved in the sponsorship process to ensure they understand their roles and responsibilities in maintaining compliance. 10. Conduct regular internal audits to identify potential issues or areas for improvement and take corrective action as necessary.
