Protect Your Rental Property from Fraud! Did you know that if someone tries to fraudulently mortgage your rental property, the notification from the Land Registry will be sent to the property address? If the fraudster happens to be your tenant, they’ll get the notification, leaving you completely unaware. Take, for example, the 2008 case of Barclays Bank v. Guy. Mr. Guy’s property was fraudulently transferred into someone else’s name, and a mortgage was taken out. Although Mr. Guy eventually got the property back, he was still bound by the mortgage because Barclays Bank had acted in good faith based on the Land Registry records. He ended up having to repay the mortgage on his property, without having received any of the funds, which went to the fraudster. To avoid this nightmare scenario, make sure your contact details with the Land Registry are current and sign up for their free Property Alerts service. You can also register a restriction, which ensures that no dealings - like a transfer or mortgage - can be registered without proper identity verification by a solicitor or conveyancer.
