On August 20, a federal judge in Texas set aside an #FTC rule seeking to ban #noncompete agreements nationwide, finding that the FTC “promulgated the non-compete rule in excess of its statutory authority.” This means that the FTC’s ban on non-compete agreements will not be enforced nationwide nor take effect today, its original effective date. Will the FTC appeal the judge's decision? The FTC is seriously considering it. If the decision is appealed, it could take many more months before the issue is conclusively resolved. In the meantime, legal oversight for non-compete agreements reverts to state law.
