Allowing #NIL compensation for college athletes has resulted in uncertain regulations and grey areas regarding what is acceptable. A recent lawsuit has brought attention to these issues. In re: College Athlete NIL Litigation: Settlement Agreement Filed for Court Approval Last week, the parties in three cases, House v. NCAA, Hubbard v. NCAA, and Carter v. NCAA, filed a 133-page settlement agreement requesting that Judge Claudia Wilken approve the parties’ settlement. Undoubtedly, there will be objections filed that will need to be addressed by the court prior to approval.  As we recently saw in the UFC fighters antitrust $335 million settlement (Le v. Zuffa), courts can and do reject class action settlements requiring parties to go back to the drawing board. A couple of hours after rumours surfaced of the agents' successful legal challenge against The FA's (and FIFA's) new agents regulations, Phil Hutchinson and I were asked to speak about the fallout of this at the Football Transfer Forum last week. HOT NEWS: A very interesting take from a legal expert on virtually everything Conference Realignment. The Super Conference could very well become a reality, as while politicians have publicly grandstanded for their state universities before (see Oren Hatch for Utah), there will be a multitude of Congessional and Senatorial protests from roughly a third of the United States who want their schools to have an inopportune at the highest level of athletics. He believes the number is indeed eighty, with eight divisions of 10 is the number and that protects all current P4 teams, quite a few current G5 teams, and #NotreDame. 🏈

Former University of Southern California star and Heisman Trophy winner Reggie Bush is filing a defamation lawsuit against the NCAA for what his legal team calls, "attacking his character through a completely false and highly offensive statement that was widely reported in the media and substantially and irreparably damaged his reputation." These claims stem from Mr. Bush's alleged involvement in a "pay-for-play arrangement" --as deemed by the NCAA -- for receiving impermissible benefits during his three seasons with the Trojans. Following a NCAA investigation, Bush's statistics were wiped from the record books and his 2005 Heisman Trophy forfeited. USC was also forced to disassociate from Bush for a 10-year period that ended in 2020. Bush's camp contends that he had no such arrangement during his time in Los Angeles, and as such the NCAA's claims at that time were "completely false and highly offensive," and led to significant damage to his reputation. As a public figure, Reggie Bush faces a much higher burden of proof in this case. If the NCAA's team can effectively assert that Bush was in fact a public figure at the time, Bush's attorneys would in turn need to demonstrate actual malice on the part of the NCAA to win this case. #SportsBiz #sportslaw #law #legal #football #collegesports #college #university #california #ncaa #nil #defamation #linkedinsports Via https://lnkd.in/gRXHtWaY
