Why has Arizona allowed developers to build without water & who will be held liable for this egregious corruption? A building permit should not be issued unless a builder/developer can guarantee a 100 year water supply, right? The 1980 law requires new subdivisions to have a 100-year assured water supply. So why are so many areas, like Queen Creek, booming with new subdivisions, when they do not have a 100-year assured water supply? Intended to manage water resources responsibly, these regulations can pose unexpected hurdles for property owners seeking to enhance their homes. Consider the journey of one homeowner, whom I represent as their listing agent in 2024. During their 2008 remodel, they faced a significant roadblock in the form of a deed restriction linked to water usage. Despite efforts to modernize, adding a second bathroom triggered a frustrating limitation – a restriction on further increasing water usage. Even switching to a low-flow toilet failed to unlock additional water credits, highlighting the complexity of the issue. Conflicting information from regulatory bodies like the Monterey Peninsula Water Management Company and the city of Seaside only added to the frustration. Navigating this bureaucratic maze, a seemingly simple request to legalize a laundry sink became a challenge due to the intricacies of water credits. The solution? Providing a washing machine for the buyer, ensuring compliance with regulations while protecting the seller's water credits in case of escrow complications. As their broker-realtor, my priority was to ensure my client's interests were safeguarded. This story underscores the intricate dance homeowners must navigate when confronting deed restrictions related to water usage, and is an example of complexities I and other realtors come across during a transaction. This challenge required my taking immediate action mid-escrow to jump through hoops to close on time. My goal was to keep water credits (high value) for my seller on the off chance escrow fell through.
