Arzinger successfully represented a client in multimillion cross-border litigation arising from the russian blockade of Ukrainian ports. Arzinger was a part of an international team of lawyers from the US, the UK and the Netherlands who assisted the client in a dispute under English law in the Dutch courts. The client suffered from the russian blockade of Ukrainian ports – the client's goods were stuck on the ship and could not leave the Ukrainian port. In this case, Arzinger's team ensured extensive evidence collection in Ukraine, secured reports from reputable experts in very specific fields, and provided advice on the various issues of Ukrainian law. The dispute worth tens of millions of US dollars was settled for the benefit of the client. Its opposite is “mala fide” or “in bad faith”. A fundamental concept in law since ancient Roman times, it’s still used in legal systems around the world two millennia later! In South Africa it remains ubiquitous in our court decisions and legislation. Whether or not something is found to be “bona fide” can often make or break the outcome of litigation. #Law #Letigation #BonaFide

Dr Boris Prastalo (Lecturer in Commercial Law) had another short article published yesterday on Kluwer Arbitration Blog (Wolters Kluwer: International Arbitration & Mediation). In the article, Dr Praštalo first provides "a brief historical overview of the 2019 Hague Convention as well as the rationale for its adoption. On 19 September the annual Forbes Federal Legal Forum (https://lnkd.in/dSMQ-5s6) will be held in Moscow - a key event in the field of legal business, where Anna Zabrotskaya, partner at Nordic Star Law Offices, will take part in the debate on the topic "Hello, Through the Looking Glass! International Arbitration for Russian Companies - Is the Game Worth the Candle? "Yes, it's worth it" or "No, it's not worth it". During the debate, participants will be divided into two teams. One team will argue that international arbitration remains the most effective and least risky method of dispute resolution for Russian companies. The opposing team will argue that the alternative should be to refer disputes to Russian state courts, citing, inter alia, the provisions of Art. 248.1 of the Arbitration Procedural Code of the Russian Federation and other legislative norms.
