Job Title: Land Acquisition Manager Job Description: Responsible for end to end process of Land Acquisition (private, government, agricultural, etc.) for large industrial expansion. Identifying large blocks of Lands as per client’s requirement and complete the acquisition process along with all the formalities (registration, mutation, etc.). Responsibilities: - Understanding Client’s requirement in terms of land use, land size and preferred location based on availability of other resources - Identifying large blocks of lands for the Industrial Expansion. - Assessing and carrying out the valuation of the Lands. - Authentication of registered property title documents. - Reading agreements and sale deeds (for the lands to be purchased). Negotiation and Concluding the Deal - Initiating the discussions with the respective Government department for buying their lands (including waste lands, forest lands and fallow lands) and negotiations for the best purchase price. - Talking to farmers/intermediaries/ land owners and convincing them to part with lands, obtain land records, gather details of legal heirs and outstanding liabilities, etc. - Negotiation with all Land Owners for the best possible price of the land - Completing the purchase process Liaison with External Agencies - Liaise with revenue Officials for survey of lands, registration and mutation of land records etc. - Liaise with relevant departments to ensure that identified legal risks are mitigated and appropriate courses of action have been taken. - Title search, registration formalities and co-ordination with revenue and other government and Municipal body for necessary approval required for land and property acquisitions. - Maintaining cordial relations with farmers, Government Officials (particularly Tehsildars) and mobilizing public support - Coordinating with advocate in getting encumbrance certificates, legal opinions, etc. - Maintaining the land records and Research - Proper upkeep of the Land records, purchase agreements and other relevant documents. - Giving suggestions and opinions to the management on related issues along with research work on various legal issues. - Provide holistic support to the Site Team in all matters and getting permissions/clearances from authorities etc. - Apprising the Senior Management regarding the progress of Land Acquisition progress and suggesting future course of action as per the requirement If you are a dynamic and self-motivated professional, we encourage you to apply for this exciting opportunity. Let’s talk about how the stamp duty on title document is calculated. Before land registration commences, your land document will undergo the stamping process. As mentioned previously, the essence of stamping a document is the ability to administer such a document in court. As a prerequisite to land registration, your title document will be assessed after you present it to the Land Valuation Division at the Client Service Access Unit (CSAU). The assessment is based on the type of document being presented. Your title document will be made available to you along with the stamp duty bill to enable you make the payment. The document can be picked up at the CSAU using the presentation slip. Assignments and Subleases are assessed at one percent (1%) of the property value. The Land Valuation Division may request to visit your property for valuation purposes to enable them arrive at the assessed value. In a nutshell, it is prudent to prepare about one percent of your property value for the stamp duty fee. Be sure to pay the stamp duty at the CSAU (Client Service Access Unit) or via the Ghana.gov.gh platform using the stamp duty bill reference after assessment. There will be the need to resubmit your title document along with the receipt of payment to the CSAU for embosement. Check in once a week to ascertain if the stamping process has been completed. Why hire a Professional Land Surveyor? One reason is that sometimes, record title lines do not match legal title lines. If this is the case, your surveyor will be able to help you update the record to the legal positions. After doing so, property taxes are updated, boundaries are clearly monumented, and the public is protected. For instance, this fence was found off bearing of the record and about 6 feet East. But yet, it is clear that this has been relied on as a boundary for a long time, with the fence and the tree becoming one. TAKING OVER FROM FAILING MUNICIPALITY Koingnaas was a mining town established, owned, and controlled by De Beers and provided services to its residents. De Beers partially transferred municipal services of Koingnaas to the applicants, Kamiesberg Local Municipality (KLM), in terms of an agreement relating to the transfer of municipal services. The ratepayers maintain that their services have deteriorated since the transfer from De Beers to the municipality, hence they took over some of the services which constrained them to bring litigation. The respondent claims that KLM is failing to maintain the roads infrastructure and to render water and sanitation services. The respondent and its members started repairing the potholes. This led to confrontation with members of the South African Police Service set upon them by KLM. The fact that the respondent is effecting repairs to the roads and was in the process of rendering an invoice or has already rendered an invoice of R120,000 to the municipality, without any formal procurement processes, renders them in conflict with the provisions of section 217 of the Constitution. The conduct of the respondent amounts to self-help contrary to the spirit and purport of the Constitution. The respondent has therefore arbitrarily arrogated to itself a monopoly as sole service provider. The services have not been sanctioned by the municipal council and have closed the door to fairness, equity, transparency, and competition. Legislatively, the responsibility to render municipal services lies with the municipalities. The applicants bear the right to carry out their obligations as the accounting office and officer. Whether there stands to be apprehension of harm suffered by the applicants is irrefutable. The intentions of the respondent may be well and good but without following proper processes and ensuring that they are fair, equitable, transparent, competitive, and cost-effective, it is impermissible. The respondent acknowledges that its members took over the repairs of the road and intended to take over all the infrastructure and buildings and effect repairs or perform whatever function necessary. The applicants have established breaches of the rights sufficient to interdict the respondent and its members from taking control of the municipal infrastructure.
