Since the Biden administration implemented its newest asylum ban rule, people seeking safety at the U.S.-Mexico border have experienced egregious legal and human rights violations along with inconsistent and confusing application of the new legal requirements. Along with the National Immigrant Justice Center, Human Rights First, Immigrant Defenders Law Center, Refugees International, Kino Border Initiative, Hope Border Institute, Women's Refugee Commission, Las Americas Immigrant Advocacy Center, and National Immigration Law Center, we have released a new report documenting the human rights and due process violations at the border in the first six weeks of the Biden administration’s Executive Order issued in June which severely limits the right to seek asylum. The report includes stories of more than 30 people who have sought asylum since this rule went into effect. Combined with the Biden administration’s May 2023 asylum ban, the newest rule flouts the U.S. government’s legal obligations by summarily deporting refugees to danger, stranding asylum seekers in Mexico where they are vulnerable to severe harm, and in some instances compelling family separation. 🔗 https://lnkd.in/gHJYcYzA

Another one of our "common misconceptions" series - are asylum seekers screened at the border? The short answer is - yes ❗ Any asylum seeker who presents themselves at the border requesting asylum goes through a rigorous screening process. Further, the right to seek asylum was incorporated into law following World War II. Congress adopted key provisions of the Refugee Convention (including the international definition of a refugee) into U.S. immigration law when it passed the Refugee Act of 1980. Let me reiterate this again: ❗Seeking asylum is a human right protected under our laws❗ When people arrive to request asylum at the border, they go through a rigorous screening process that generally includes fingerprinting, background checks, medical screens, and a credible fear interview, just to name a few. Many people are detained during this process. Many families have been separated during this process. The new EU Migration Pact already prompts international worry. Last week, a group of UN experts (Special Rapporteurs) issued a joint statement where they express concern at the risk that the Pact would generalise immigration detention at borders, for both children and adults. The experts called on EU members states to prohibit immigration detention for children, and ultimately end this practice for adults too. “Asylum seekers should not be penalised for exercising the right to seek asylum, and migration should not be criminalised,” they said. The experts also called on EU member states to: 📌 establish independent mechanisms to monitor strict respect for human rights during screening and border procedures 📌 refrain from collective expulsions 📌 assess protection needs individually under international human rights and refugee law 📌 prevent racial profiling by immigration and law enforcement officers 📌 protect the rights of migrants and asylum seekers with disabilities 📌 expand and diversify pathways for regular migration Read the full statement on: https://lnkd.in/gf7JU_qw

⚖️ Today, the Supreme Court has ruled the government’s policy to deport asylum seekers to Rwanda is unlawful, backing the Court of Appeal’s judgment. We have previously questioned the Rwanda policy and questioned the compatibility with the Refugee Convention and the European Convention on Human Rights. In particular, we raised concerns in relation to asylum seekers being returned to their own country from Rwanda. This was the legal ground that the Supreme Court found the policy unlawful. As our president Nick Emmerson states: “Today’s ruling was a clear and unanimous decision from five independent judges. The government should now switch focus to clearing the existing asylum backlog and tackling the severe lack of capacity in the sector to provide the asylum and immigration advice needed.” He also added that this ruling must also “call into question the Illegal Migration Act as a whole as it is heavily connected to the Rwanda policy.” “The Act is reliant on removing people from the UK. The Rwanda removals agreement has been ruled unlawful and there are currently no other removal agreements in place to ‘safe’ third countries. “A growing number of people will be left in limbo under the Act as they cannot be removed, and they cannot be granted asylum. “The cost to the taxpayer will continue to increase as the individuals left in limbo are housed in either detention centres or Home Office supported accommodation indefinitely. “This therefore undermines both the government’s justification for the Act and its ability to offer a sustainable solution for the UK’s asylum system.”

In case you missed it: "The Biden administration released a new proposed rule...adding more restrictions to already compromised asylum systems at the U.S.-Mexico border. The changes would dramatically limit access to asylum — a life-saving protection that for decades has been available for people fleeing persecution or torture. Concurrently, the Biden administration announced new internal guidance and released a new memo for asylum and immigration adjudicators that further vilifies migrants and asylum seekers and authorizes broader use of secret evidence. .....Contrary to the narrative now being promoted by extremists, the Biden administration, and many media outlets, people seeking refuge at our border have a right to seek asylum under current U.S. law.
