As a member of a JNC, you will help review applications for judges and send recommendations to the Governor for appointment. The BOG is currently seeking applicants for 20 seats on 13 JNCs. Restorative justice is a framework based upon a dynamic interplay of legal and social principles and practices that are focused on centering both the harm and healing by creating space and tools for persons to embrace a firm compassionate informed accountability to self and community, vulnerably reintegrate with those immediately involved and the larger society, and move towards a transformative reparation that restores all. We have these others terms and definitions of criminal justice philosophies like that of retributive justice, whereby crime is seen as acts in violation of government established norms codified as law, and rehabilitative justice, whereby, a therapeutic approach focused on some sort of treatment needs at issue. And then, as if somewhere off in the land of obscurity, we have this concept of restorative justice that seems to only apply in certain contexts. But in reality, wouldn't and indeed shouldn't the best paradigm of justice embrace elements of each. When we examine many of the specialty courts, we recognize and praise the value of evidence based practices, appreciating that the relics of purely punitive based criminal models are not only ineffective but counter productive. Yet, the irony is that most courts continue to operate with traditional models, with in many instances the state prosecutor being the deciding entity that selectively determines which cases and which individuals are eligible for this better approach. Yet once we know better, shouldn't we try to do better for all? Shouldn't those more informed practices be extended to each person in each court?

https://lnkd.in/ewertbFS The Supreme Court noted that family law matters are diverse and complex and that courts need wide discretion to come to a fair result. It said courts must balance a child’s need for regular and appropriate support with the need for flexibility when a parent’s ability to pay is affected by changes in income over time. The framework recognizes two long-established principles of Canadian child support law. First, children have a right to a fair standard of support. That is a core objective of the Guidelines. Secondly, parents are obliged to financially support their children starting at birth and continuing after separation. The Supreme Court also explained that since the Guidelines came into effect,the payor parent is under a free-standing legal obligation — independent of any court order — to pay child support in line with their income.
