RED ALERT! This is not a drill! If you have employees in California an important deadline is coming up on February 14th. AB 1076, signed into law last fall, requires all California employers with any current or former employees who were employed after January 1, 2022, and who were required to enter into unlawful non-compete agreements or had unlawful non-compete clauses in their employment agreements, confidentiality agreements, handbooks, etc., to notify those former and current employees, in an individualized writing, by February 14, 2024, that any such non-compete agreements or clauses are void. (Note that the non-compete agreement or clause at issue can pre-date January 1, 2022.) Failing to provide this required notice constitutes an actionable act of unfair competition. UPDATE!! The FTC non-compete rule has been blocked NATIONWIDE by a federal court in Texas. It will not go into effect on Sept 4. The court held that the FTC lacked authority to issue the non-compete rule and that the rule was arbitrary and capricious. The FTC may try to challenge the court’s ruling, but for now, companies can continue utilizing lawful non-competes. #ftc #noncompete #nationwide #employmentlaw #hrlaw
