The Biden Executive Order on AI set forward a path for responsible uses of AI in government and beyond, and set a key role for privacy enhancing technologies that you can be used in support of AI. At Future of Privacy Forum we are excited to help advance legal certainty, standardization and (most important) ethical uses of PETS. Looking forward to meeting with key Administration, civil society, academic and industry experts at the White House to kick this effort off today.

Björn Lubetzki and I were able to virtually participate in the conference “Shaping AI: Democratic, Sustainable, Innovative” today as part of Bridge the Gap. There were very exciting lectures and workshops, including on AI in the context of mental and physical health. We were able to address the issue of bias here. Generative image AI systems reinforce stereotypes by reproducing clichés, for example when they only create hospital wheelchairs. It becomes life-threatening in the truest sense of the word when AI systems with a bias are integrated into medical decisions, such as triage or life-sustaining measures. However, it should also be noted that doctors (i.e. people in general) can also have prejudices against disabled people. So the discussion should actually be broader. Data protection and privacy are particularly important for vulnerable groups. Care should be taken to ensure that the systems run on the devices and not via a cloud. Digital health applications can be a great support for people with disabilities. However, the certification of AI systems is particularly complex because they may continue to develop and therefore contradict the regulatory criteria. Of course we have to pay attention to security and data protection, but it must be understood that we don't get in the way too much as a society.

Thanks to AI, healthcare innovation is hitting warp speed, but with progress comes concerns about implicit bias, and security and privacy issues. President Joe Biden signed an Executive Order 4110 entitled the, “Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence,” which establishes a policy framework to manage the risks of AI; to direct agency action to regulate the use of health AI systems and tools; and to guide AI innovation across all sectors, including in the health and human services sectors. This technology has the potential to directly help patients, including by allowing doctors and hospitals to spend less time doing paperwork and more time providing care. It also offers hope to those battling deadly diseases that this technology may improve research and development into new treatments and cures,” said Chairs Rodgers and Guthrie. “That said, this level of AI utilization is a new frontier in health care, and this committee has a vested interest in ensuring that it is improving patient care and driving innovation—not being used to supplant the clinical judgement of physicians or indiscriminately limit access to care. It’s also critical that the data that feeds AI is not collected, used, or shared without one’s consent when it may be personally identifiable—which is often not protected under current law.
