New York Knicks v. Toronto Raptors: Commissioner’s Authority to Arbitrate Team Disputes Upheld The New York Knicks (“Knicks”) brought suit against the Toronto Raptors and several employees (“Raptors”) in the United States District Court for the Southern District of New York. The Knicks argued that the Raptors poached a front office employee and instructed him to take the Knicks confidential and proprietary information on the way out the door to gain a competitive advantage. The Knicks set forth claims under the Computer Fraud and Abuse Act, the Defend Trade Secrets Act, misappropriation of trade secrets under New York state law, breach of contract, tortuous interference with contractual relations, conversion, unfair competition, and unjust enrichment. The Raptors filed a motion to compel arbitration arguing the dispute should be brought before the Commissioner of the National Basketball Association (“NBA”) and not in court. Both the Knicks and the Raptors are governed by the NBA Constitution and By-Laws (“NBA Constitution”). 🔍 Hyde v Djurberg Case Background: ➡️Mr. Djurberg sold a property post-bankruptcy and received £217,000 as a settlement payment. ➡️The TiB claimed this as after-acquired property, leading to court proceedings. ➡️The court ruled in favour of the TiB, emphasising the wide powers granted under the Act and the difficulty for third parties to rely on the Section 307 defence. David Garner and Owen John from our Commercial Disputes team report on it here https://shorturl.at/Ip9AU This case highlights the critical obligations of bankrupt individuals and the broad authority vested in trustees in bankruptcy. It is a vital reminder of the complexities and challenges in proving third-party defences under Section 307. #insolvencyact #bankruptcylaw #legalupdate #CommercialDisputes
