https://lnkd.in/gbQHCQen We do NOT want martial law! We want a civilian government that is capable of providing for the national defense so that martial law is not necessary. It is questionable right now whether Joe Biden, Kamala Harris or (potentially as of next January) Donald Trump is fully prepared for that responsibility as Commander in Chief. Think of martial law not as intended to control the American people, but rather as a last resort to defend the American people from foreign attack. "The Constitution does not mention martial law, and no act of Congress defines it. The Supreme Court has addressed it on only a handful of occasions, and the Court’s reasoning in these decisions is inconsistent and vague." With Russia & China providing support to Iran in attacking Israel, the United States may be faced with a need for very serious leadership decisions perhaps literally overnight. This requires military expertise that civilian leaders are not competent to oversee. That's a constitutional crisis because we keep electing these people.

"Labelling communications "without prejudice" is straightforward" or is it? BCLP partner, Shy Jackson and trainee Caroline Cwiertnia explore the impact of Pentagon v Cadman and what it means for without prejudice communications in the context of mediations #BCLP #disputes #withoutprejudice #mediation #PentagonvCadman
'Without Prejudice' is a term that is often used, but to what extent do we understand how it operates in practice and the exceptions to the rule? The recent decision in Pentagon v Cadman looks at this issue in the context of a mediation and you can find the details in this note by my colleague Caroline Cwiertnia.
