Anglo-Australasian Lawyers Society (AALS) - next Breakfast Seminar - Thursday 29 August 2024 The next breakfast seminar of the Australian Chapter of the Anglo-Australasian Lawyers Society (AALS) will be held on Thursday 29 August 2024 at 7:30 am, with an address by ALAN SULLIVAN KC on: IN WHAT CIRCUMSTANCES WILL AUSTRALIAN COURTS DEPART FROM THE "BUT FOR" APPROACH TO CAUSATION IN NEGLIGENCE CASES ? Notwithstanding its formal displacement by the “commonsense” approach under Australian common law (following the 1991 decision of the High Court in March v E & MH Stramare), the “but for” approach continues to be of importance in the determination of factual causation in negligence cases. This is especially following the recognition of that approach in s.5D of the Civil Liability Act 2002 (NSW). In this Seminar, Alan Sullivan KC will address both how the “but for” approach continues to be of importance in determining factual causation in Australia and in what circumstances Australian Courts may depart from that approach.
