On Monday, March 25, 2024, after just over 7 years of litigation, a Delaware federal court sided with Sony Corp. in Genuine Enabling Technology’s $500 million lawsuit against the maker of PlayStation. GET’s lawsuit (case number 1:17-cv-00135, filed in 2017) asserted that Sony's PlayStation products, including the PS3 console, DualShock 3 controller, PS4 console, DualShock 4 controller, and Move controller for motion-control gameplay, infringed on GET’s '730 Patent (Patent No. 6,219,730, Method and Apparatus for Producing a Combined Data Stream and Recovering Therefrom the Respective User Input Stream and at Least One Input Signal) by employing distinct frequencies for button inputs and motion control. Agreeing with Sony's argument that GET failed to provide enough evidence to prove Sony’s accused Bluetooth module was structurally equivalent to block 34 of Figure 4A in GET's patent under the function-way-result test, U.S. District Judge Mitchell S. Goldberg granted Sony’s motion for summary judgment. GET plans to appeal the decision to the Federal Circuit.
