We are pleased to have assisted The Woodland Trust in the successful outcome of the Judicial Review. We would like to thank Environmental Law Foundation and Siân McGibbon of Landmark Chambers for choosing Lester Aldridge to assist with the filing of the application for Judicial Review and to bring the matter to a successful conclusion. Litigation update - interesting case about the doctrine that a party to litigation is required to disclose relevant documents within the party’s control. Amati Law is advising currently that in certain circumstances, the court considers that a litigant has control over documents held by a third party even where the litigant has no legal right to those documents. And documents within the litigant’s “practical control” may be disclosed. See The Public Institution for Social Security v Al-Wazzan & Ors [2024] EWHC 480 (Comm). In practice the facts may make it challenging to establish the required “practical control”. #litigation #Jerseyci #AmatiLaw

Many of our litigation cases are of deep personal significance to the parties involved. With emotions running high, this can sometimes become a bar to settlement. In some cases, it might be helpful if one party could offer an apology without fear of that apology being used against them in subsequent proceedings.   As a matter of common law, an apology is not an admission of liability and section 2 of the Compensation Act 2006 provides that an apology shall not of itself amount to an admission of negligence or breach of statutory duty. However, the Government is now consulting on whether to grant apologies additional statutory protection, and thus encourage their use in commercial disputes. In Brenda’s article ‘A obituary for Chevron defence’, written in collaboration with Damien Morris of Banco Chambers, she discusses a recent judgement in the Supreme Court of the United States that has overturned the doctrine widely known as the Chevron defence that required courts to defer to an administrative agency’s interpretation of ambiguous statutory language. Two articles in The Guardian yesterday giving powerful context for the upcoming wider Civil Justice Council review regarding the role of #litigationfunding in the pursuit of #accsesstojustice. The first is an opinion piece from Alan Bates, reiterating (after his previous piece in The Times) how litigation funding is perceived by those who actually need it and the crucial role it played in bringing the Post Office scandal to light. The second is an article highlighting the “concerted effort by big business to constrain access to the kind of funding that allowed the post office operators to bring a landmark case against their former employer". It's worth remembering that no claimant, whose case is rejected for funding by a litigation funder, celebrates when their application is rejected and the review's success will be measured by how it helps increase, not decrease, victims of wrongdoing to seek legal recourse more fairly and easily than the current system allows.
