In the latest 2023 World Justice Project Rule of Law Index, Bangladesh ranks 127th out of 142 countries, with an overall score of 0.38 out of 1.00. In the South Asian context, Bangladesh is positioned fourth among six nations, falling behind Nepal, Sri Lanka, and India, while surpassing Pakistan and Afghanistan. Our findings highlight ongoing challenges in Bangladesh's legal and governance systems, particularly in important areas such as accountability, transparency, and access to justice.These results are part of a broader global trend, as we have observed a sixth consecutive year of decline in #ruleoflaw adherence worldwide. The creation of the Interim Government in Bangladesh has caused many to pull out their constitutional hairs. Questions have been raised about the legitimacy of the Interim Government. The international development community is closely monitoring the political landscape of Bangladesh. Our Managing Partner, Barrister Junayed Chowdhury has recently advised a major international development organization on the legitimacy of the Interim Government. The advice concluded that the Interim Government is legitimate under the laws of Bangladesh. It is high time for fundamental structural reforms within state policy and governance. It’s now or never—there is no guarantee that the next political government will make the necessary changes Unfortunately, the 1972 Constitution contained many self-contradictory provisions, including Article 70. There may be arguments about whether that provision was necessary at the time, but now it is completely irrelevant, illogical, and impractical. Furthermore, we now have a wealth of legal experts and political scientists, such as Dr. Ali Riaz, both within and outside the country. We should utilize their expertise. The context of Bangladesh today is vastly different from that of 1972.

Pakistan faces several challenges that impact its governance and development, including internal political dynamics, corruption, foreign influence, and economic instability. The persistence of these issues can hinder effective governance and sustainable growth. Bangladesh has a window of opportunity now for much needed economic reforms. What should be the guiding principles for approaching the reforms from a market systems perspective? Three things come to my mind: 1) minimum state intervention in the market 2) fostering competition and 3) simplification of laws, regulations, and processes. Any other thoughts?

This is the first of a webinar series hosted by the diaspora the Diaspora Alliance for Democracy. This webinar series explores the critical issues shaping countries around the world including democracy, human rights and economic progress. As Bangladesh emerges from revolutionary change, constitutional reform becomes a critical foundation for establishing sustainable governance and protecting civil liberties. This webinar explores the complexities and significance of post-revolution constitutional reform, focusing on how new legal frameworks can promote democracy, protect human rights, and strengthen institutions. They also explored the legal implications of a resignation letter signed by a the ex-prime minister of Bangladesh Sheikh Hasina, the challenges faced by Bangladesh in the last 15 years, and the consequences of the Constitution's second amendment. Lastly, they examined the transformation of Bangladesh from a liberal democracy to an absolute dictatorship until Hasina fled to India and the mechanisms to balance political input with impartial expertise and long-term national interest in the constitutional drafting process.
