I had the wonderful opportunity to complete the Ashurst "UK's Energy & Infrastructure Projects" job simulation on Forage. As a recent law graduate, this gave me a lot of valuable insight and practical skills for a future career in law. This job simulation taught me how to: 1. Advise a client on contractual terms in an O&M agreement for Ashurst's Projects team. 2. Review and analyse an excerpt from an O&M agreement with accuracy and attention to detail. 3. Demonstrate legal drafting skills by effectively amending the termination clause to align with the client's preferences, including the incorporation of a 'termination at will' clause and a reimbursement provision. 4. Draft a note to the opposing party's lawyers explaining the drafting change and its purpose. Check out the simulation here: https://lnkd.in/eNv4NVQK

Australian lawyer | Living in the UAE | Arbitration | Litigation | Commercial and Corporate | Civil & Criminal Litigation
🚨High Court Decision Alert🚨 The High Court delivered a pivotal ruling in CBI Constructors v Chevron [2024] HCA 28, a must-read for those involved in arbitration and project disputes. 🏛️ Key Takeaways: 🔑 Enhanced Clarity on Contractual Obligations: The court's ruling provides much needed clarity on the enforcement of contractual terms and the scope of contractor responsibilities. This would undoubtedly shape the future agreements and dispute resolutions. 🔑 Impact on Industry Practices: With its decision, companies and contractors will need to revisit and potentially revise their contracts to align with the court's interpretation. This shift could influence everything from project management to compliance strategies. 🔑 Broader Implications for Legal Precedents: The ruling contributes to the evolving body of case law, offering valuable insights for legal professionals navigating similar disputes. In this case, the Court addressed the risks of bifurcated hearing structure, where liability and quantum are dealt with separately. The tribunal's overreach in considering liability issues during the quantum phase led to the High Court upholding the Western Australian Court of Appeal's decision to set aside the quantum award. 🔧 Whether you're a contractor, legal professional, or involved in project management, the decision reinforces the principle that arbitration awards can be set aside when a tribunal exceeds its jurisdiction. #Arbitration #HighCourtofAustralia #Legalupdate
