Discovery alert 📣 for Canadians litigating in Florida courts: take note of the Apex Doctrine. An excellent analysis in Law 360 (attached here) explains how the doctrine (codified in a procedure rule) impacts deposition requests for high-ranking corporate officials in the ☀ state. The rule will significantly impact litigation in Florida involving corporate entities. The Florida Supreme Court recently denied the Attorney General's motion for reconsideration of the rule, which means the rule is finalized. Now, when a deposition notice is issued to a corporate official, the initial burden is placed on the high-ranking official to file a declaration explaining why (or how) that officer has no unique, personal knowledge of the litigated issues. The rule is a significant assert for litigants seeking to depose high-ranking corporate officers in Florida. As the article notes, there are still m gaps that Florida courts will likely address, which means practitioners must stay alert. The adoption of the Apex Doctrine by Florida means it’s one of only a few other states (CA, GA, MI, TX and WV) with this rule.
