Well, that’s another Tolota settled in arbitration, following ADR (settlement meeting) just 8 days before the final hearing. Neither party will celebrate, but both will be very content at a certain outcome, reached by agreement ! They’ve both saved money on litigation costs to final hearing & the case also settled about 1 year earlier than if we had a multi track final hearing at Court. Arbitration is much quicker than court proceedings. The best bit for clients is, by and large, the friendly & flexible nature of arbitration vs Court proceedings. When clients feel more at ease, they tend to be more rational and less emotional, leading to logical decision making, and, guess what…… settlement of their case by agreement ! As you can tell, i’m a big fan of arbitration & encourage all family lawyers to push for it for their clients, where possible / necessary etc… Top tip - get to grip with costs orders, Part 36, calderbank & open offers - pre & post the arbitration agreement.
