YES! Family law decisions can be appealed in British Columbia for errors of law, significant errors of fact, or a combination of the two. https://lnkd.in/gpXaUrfa The stated reason for the new legislation is a false promise by government. It will do nothing to advance access to affordable legal services, and for those who can't afford anything and have legal troubles where there is no money or relatively little money involved, not assist them to retain any form of privately paid legal assistance. Notaries, who generally charge as much as lawyers for the services they provide, and licensed paralegals when we get some, have to make a sustainable income to stay in business just as lawyers do, In Ontario, which has had licensed paralegals for years, there has been no move on the access dial, as the paralegals take the clients who pay like landlords or people with money fighting tickets in traffic court. If the government was serious about this rather than hypocritical it would use the billions of dollars it has collected in PST on legal fees, making it MORE expensive for people to access legal help and put them where they promised decades ago - into legal aid and other assistance for those who cannot afford services privately - rather than almost all into general revenue like now. Don't drink the government Kool-aid. This move is about government interference in legal regulation and nothing else.

“My ex is refusing to mediate but I do not want to spend money on legal fees, what can I do?” As Family Solicitors this is frustratingly something we hear often. I like to work collaboratively and encourage disputes to be sorted if possible outside of a court process which can prove to be both costly and lengthy. But what can you do when the other person simply will not engage? Upcoming changes today ** 29th April 2024 ** mean the Family Procedure Rules are trying to encourage the use of ‘Non-Court Dispute Resolution’ to bring down the number of separating couples who find themselves in court proceedings regarding their children and/or finances and to criticise and sanction those who fail to consider alternatives. The amended rules which came into force today signify a significant shift towards prioritising non court dispute resolution in family law matters. The effectiveness and application of those changes will unfold in the coming months, shaping the landscape of family law dispute resolution.
