As Ultra is happening on the East Coast, Beyond Wonderland unfolds on the West, and we were curious about the agencies behind this years Beyond Wonderland 2024 line-up. We used Booking Agent Info to research the agencies behind this years festival. (With a bit of rounding for simplicity) Interestingly, the top two agencies representing artists at Ultra are the same ones behind the lineup for Beyond Wonderland. United Talent Agency and Wasserman claim over half the artists at Beyond Wonderland, with UTA at the forefront with 30%, closely shadowed by Wasserman’s impressive 24%. A whopping 37% of the festival’s diversity is credited to a mosaic of other agencies, along with artists who handle their bookings in-house. This portion is not just significant, but it’s the very heart of the festival’s variety. Creative Artists Agency (CAA) represent 2% of the lineup, but that 2% are powerhouses The Chainsmokers and Alesso. Similarly, Corson Agency and Wright Bookings each account for 2%. David Lewis Productions secures 3% of the lineup, a figure that mirrors their representation at Ultra Music Festival. Stacey, it's wise for brand owners like Coachella to rigorously protect their trademarks. Their brand equity and reputation are critically valuable assets that can be easily diluted or tarnished by copycats trying to trade off their success. This recent legal victory against the "Moechella" festival reaffirms that courts take trademark infringement seriously, especially when there appears to be intentional imitation aimed at causing consumer confusion. As the judge noted, the similarity between the names and nature of the events makes it likely many would mistakenly associate Moechella with the famous Coachella brand. Brand owners invest tremendous resources over many years building brand recognition and equity. Trademark law exists to prevent freeloaders from unfairly exploiting that brand equity for their own gain. Infringers not only cheaply benefit from someone else's brand value, but they can also tarnish and dilute that brand in the minds of consumers. This case serves as a cautionary tale for others. Blatantly piggybacking off of someone else's famous trademark is legally risky. The smarter approach is to invest in creating a truly distinctive brand identity rather than trying to draft off someone else's coattails through conspicuous imitation. For musicians and event organizers, a little creative thinking to develop a uniquely memorable brand name could prevent an expensive trademark lawsuit down the road.

I've reported before about how vigilant Coachella is about enforcing its trademarks (and they should be). Earlier this year, the owners of the Coachella music festival filed suit against a DC music festival called Moechella and earlier this month, a U.S. District Court Judge Walton issued a preliminary injunction against the DC festival ordering that using the Moechella branding for live music and other events in DC is likely to cause confusion. Not only are the two marks and events similar but "it appears that the defendants intentionally selected Moechella to imitate the Coachella Marks," Judge Walton said. Another win for Coachella. Here's a word to the wise. If you want to put on a music festival, do not name it with anything ending in -chella. You will likely be sued! #brandprotection #trademarks #trademarkinfringement

I love a good festival, but let's be real: by the end of each night, my legs were screaming and every step felt like I was walking on glass (IYKYK). Disappointed would be an understatement to describe the experience customers are having with BookMyShow’s SPXCEJXM Festival. Here’s a breakdown of the timeline: August 19th, 2023: BookMyShow listed a music festival to be held on November 4th & 5th, 2023, in Mumbai & Bengaluru, featuring artists like Kodaline and Ali Gatie. October 15th, 2023: BookMyShow notified all customers of the festival's postponement to April 27th-28th, 2024, due to undisclosed reasons. Customers were given until November 15th, 2023, to opt for a refund or retain their tickets using a Google form. After the postponement to April 2024, the refund process turned into a saga of endless waiting. Months passed without updates, leaving customers feeling scammed and disregarded. Even as tickets were still being sold, refunds remained elusive for many credit card users. Some even considered filing an FIR against BookMyShow and the organizers. https://lnkd.in/dG326Zhe February 29th, 2024: Customers received a text message from BookMyShow stating that refunds had been processed and should be received within 7-10 working days. However, many credit card users are still waiting for their refunds. April 7th, 2024: BookMyShow's vague responses and failure to provide transaction details only added to the frustration. Despite assurances of NEFT transactions, many are yet to receive their refunds. As one affected customer, I'm left questioning BookMyShow's integrity and customer service. Their actions have eroded any respect I had for the brand. It's been over six months since BookMyShow has been holding onto customers' money without providing any substantial reason or update. This lack of transparency has left customers feeling clueless and disregarded. So, what's the next step? Should we continue waiting in vain or explore legal options? This is a good indicator that past success will not result in positive results today. However with the increase in ticket pricing some might say the event was still successful even of occupancy was down for many valid reasons. It will be interesting to see what next year brings.
