A year ago, my article on the crime of aggression was published in Stockholm University Law Journal. In the article, I argue that the Israeli armed attacks in 1948 and 1967 constitute aggressions, in legal terms. It follows that the occupation that was the result of the 1967 war was illegal, by definition, from day one, since it was the result of an aggression. In fact, the occupation is in and of itself a case of aggression. The article also covers the 1973 war, where circumstances are murkier. Key aspects of South African law include: 1. **Statutes and Legislation**: These are codified laws enacted by the Parliament of South Africa. They cover various areas such as criminal law, civil law, administrative law, and more. 2. **Common Law**: This includes legal principles and rules developed through judicial decisions over time. South Africa's common law is primarily based on Roman-Dutch law and English common law. 3. **Customary Law**: Recognized by the Constitution, customary law governs many aspects of life for communities that adhere to traditional practices. It is also partly codified but remains largely oral and uncodified. 4. **The Constitution**: The supreme law of the land, it is a written document that provides the framework for the legal system and guarantees fundamental rights and freedoms. 5. **Judicial Precedents**: Court decisions play a significant role in interpreting and applying the law, adding to the body of uncodified common law principles.
