✍️ Notarisation vs Legalisation If you do business with overseas suppliers, you will likely need documents notarised and legalised for authenticity and validity abroad. But what do these terms mean, and do you need both? Notarisation: A Notary Public certifies a document, either as a true copy of an original they've seen or as signed in their presence. Legalisation: After notarisation, the UK Foreign, Commonwealth and Development Office (FCDO) verifies the Notary's signature and provides an apostille certificate. Some countries may require further legalisation at their consulate. As a business owner it can feel overwhelming ensuring legal compliance, but many of our solicitors are Notaries Public registered with the FCDO and can guide you through the process and advise which steps are right for you. The first confirms that you are the person who signed a certain document and validates your signature. It verifies the signature's authenticity but does not confirm the accuracy or truth of the document's content. NSAs can notarize signatures on various types of documents, including:⁣ • Statutory declarations⁣ • Loan agreements⁣ • Affidavits⁣ • Letters⁣ ⁣ 📢 The second kind of notarization certified true copies of original documents, such as a photocopy of a birth certificate. Underwriters! 🛑 ✋ Stop hating 😅😂 I had to go through so much on my own closing because one person was uncomfortable. Print out docs just to hear (scanned back is enough to fund/close) So then why am I doing all this extra again???? We all know it’s not a matter of legality because every state LEGALLY recognizes e signatures and notarizations for real estate transactions. Alabama and Georgia are the two gray area states…. People who say “no” rarely ever have a real reason why either. They aren’t lawyers and don’t keep up with laws… and 3 years ago it was a standard. Online notarizations require more identity proofing so it can’t be fraud prevention….
