While I am not pleased to see yet another example of government overreach, I really do like seeing the spotlight shown on noncompete agreements. I was captive to an excessive 2-year noncompete agreement in a caustic work environment. Yes, I signed it but my options were limited...and most employers in my industry required a noncompete. When I left, I was prevented from a role that would have fed my family while I transitioned...and my former employer never would have gotten the business anyway! Moreover, the project wasn't related to any intellectual property of the former employer (I have more integrity than that anyway). Preventing me from taking that role didn't help my former employer, the organization I planned to work for, or my family. So what was the point? It was just a fear-based power grab. WHAT IF we stopped living in fear that our employees might leave and instead working on being an employer of choice? WHAT IF we let go of manipulative practices and threats and instead lead our employees and teams with vision and kindness? WHAT IF we moved beyond command and control tactics and actually looked at how to enhance employee engagement? The 2023 State of the Global Workplace Report from Gallup reported that—on average—an unengaged employee would leave for a 22% salary bump. However, it would take a 33% salary bump for an engaged employee to consider leaving. Investing in employee engagement efforts and vibrant leadership is not just good for your employees but good for your company. This new FTC regulation is likely to be challenged in court.
