Thanks to SIFMA and the Structured Finance Association for the opportunity to write on this issue, which is critically important to the consumer credit markets--and therefore to the broader economy.
The Structured Finance Association and SIFMA submitted an amicus brief to the Supreme Court of the U.S. in support of a petition filed by a group of securitization trusts who had asked the Court to review a lower court decision that those trusts are subject to the enforcement powers of the Consumer Financial Protection Bureau. The brief argues that the question whether the trusts are “covered persons” under the Consumer Financial Protection Act is extraordinarily important to the functioning of the securities and credit markets, and that the lower court decision is wrong because it (i) misconstrues the role of passive securitization trusts, (ii) frustrates Congressional intent, and (iii) is inconsistent with the U.S. Securities and Exchange Commission’s regulatory approach to passive securitization vehicles.
