In a recent Q&A with Lauren Edwards of RPC, the focus was on the transformative role of artificial intelligence in the legal sector. Edwards highlighted the importance of AI in enhancing efficiency, reducing costs, and improving decision-making processes within legal firms. She also emphasised the potential of AI to revolutionise the way legal professionals work, by automating routine tasks and enabling them to focus on more complex, value-adding activities. Edwards noted that while AI is a powerful tool, it is not a panacea for all the challenges facing the legal sector. Instead, she argued that a combination of AI and other advanced technologies, such as data analytics and machine learning, is needed to drive real change in the industry. In the context of AI, Edwards highlighted the importance of data quality and management, arguing that without good data, AI systems cannot function effectively. She also stressed the need for firms to invest in the right technology infrastructure and to ensure that their staff are adequately trained to use these new tools. The process of data cleaning and curation, while key, is often overlooked, and serves as a barrier to entry for aspiring legal technologists. Gartner recently reported that at least 30% of GenAI projects currently ongoing will not proceed beyond proof of concept by the end of 2025 for a variety of reasons such as poor data quality, inadequate risk controls, ambiguous business value, and escalating costs.”

Thanks Nicole Gill and Cozen O'Connor and Reuters for this great analysis of where we are in the uses of #genai in #ediscovery. This article poses the core questions we are all being asked, including at Everlaw, about what needs to be disclosed, particularly if Gen AI is going to be used to reduce the set of documents subject to human review. At the very least, I think that Gen AI users in ediscovery should be prepared to disclose how they are maintaining security and client confidentiality and privacy for the content of both incoming and outgoing productions. Personally, I think that when it comes to how a set of data is reduced prior to review, the same concepts of QC and sampling should apply as we do (or should) with respect to the uses of search terms, predictive coding, clustering, or any other non-review means of bulk reduction. We need the same ways to make sure that we take reasonable steps not to leave responsive materials behind. I don't think that opposing parties should be getting into the weeds of each others prompts or searches (attorney work product!) so long as the sampling and QC is reasonably complete. https://lnkd.in/g8bxsuXn

The Massachusetts Attorney General's Office just issued an Advisory concerning the use of #AI. The Advisory is essentially a reminder that there are existing laws to cover these systems, including Chapter 93A (i.e., unfair and deceptive acts and practices), Chapter 93H (i.e., protection of personal information), and Chapter 151B (i.e., discrimination). This is not just for developers - it is also a warning for USERS of AI systems like #ChatGPT, #Bard, and #Gemini.
