From the article: "There has been an increased demand among organisations for greater discipline ... in the way they defend themselves against cyber security breaches. CIRB 'no fault, post-incident' investigation is not a Get-Out-Of-Jail card Matt O'Kane raised a good question about how the CIRB would approach its 'no fault' goal, especially as it collects evidence and makes findings. The current SEC fraud charge against SolarWinds follows on the heels of a $26M 'no admission of fault' settlement of a shareholder class action lawsuit (https://lnkd.in/gaaJ6-px) a month later is a clear warning not to rely on the 'no fault' defence. The art of making 'Just Right' disclosure is probably the best defence strategy. Whilst there might be "nothing to hide,' it does not automatically mean laying all your cards on the table.
