Even though 97% of Americans want universal background checks on gun sales, failure to close dangerous loopholes in the Brady Background Check system has contributed to approximately 1 in 5 guns being sold without a background check. President Biden JUST closed the ‘gun-show loophole,’ in a move that marks the biggest expansion of background checks since the 1993 Brady Bill, and will get us as close as possible to universal background checks without Congressional action. The President who has taken the most action of any president in history to end gun violence has once again demonstrated that this is a top priority. https://lnkd.in/eiGFci2U

Missouri House Democrats have introduced resolutions to enable cities to create their own gun control ordinances, reported by Meg Cunningham. This legislative move aims at granting local governments, such as those in Kansas City and St. Louis, the autonomy to tailor public safety measures. On Nov. 7, the Supreme Court will hear oral arguments in United States v. Rahimi, a case involving the constitutionality of a Federal ban prohibiting the possession of firearms by a person subject to a restraining order in a domestic violence case. When determining the constitutionality of laws resticting rights under the 2nd Amendment, the Supreme Court applies a historical context test. As explained by Judge Thomas, “[t]o justify its regulation, the government may not simply posit that the regulation promotes an important interest. Rather, the government must demonstrate that the regulation is consistent with this Nation’s historical tradition of firearm regulation. Only if a firearm regulation is consistent with this Nation’s historical tradition may a court conclude that the individual’s conduct falls outside the Second Amendment’s ‘unqualified command.’” The Fifth Circuit in the Rahimi case stated there is “no tradition— from 1791 or 1866—of prohibiting gun possession … for people … subject to civil protective orders, and found the law unconstitutional, which ultimately sent the case to the SCOTUS. Should the SCOTUS continue to apply this historical context text in determining whether a law restricting rights under the 2nd Amendment is constitutional or not? Should the focus be on whether in 1791 there were laws preventing possession of guns by those under restraining orders in domestic violence cases, as Rahimi posits, or rather we’re there restrictions in 1791 on dangerous people having guns?

ATF Public Comment Period Nearly 80% of guns used in crimes come from unlicensed sellers who aren’t required to conduct background checks, putting communities at risk and undermining responsible gun ownership. Fortunately, ATF has proposed a new rule to clarify that many unlicensed sellers are now legally considered to be “engaged in the business” of selling firearms and must start conducting background checks on potential buyers.
