I recently used MineOS to understand the extent of and reduce my own personal digital footprint. Upon the review, the tool found that OVER 700 companies had access to my personal information of varying degrees and types! I was shocked. The good news is, MineOS has a feature where you can click to 'reclaim' your data, and, linked directly to your email, it sends an email to the company to delete your data. GENIUS! However, upon completing this exercise, I received some very interesting responses from these companies A few concerns came to mind. 1. If you are the data controller, you should know where the data is stored. If the email comes to you as the DPO, the legal counsel or whomever manages these requests, it is your responsibility to engage with other departments that can locate where the exact data is stored and processed. Whilst the technical elements of data storage are outside your wheelhouse, it is your responsibility to find this information. Last time I checked that is data protection 101. 2. Telling the data subject that you will unsubscribe them from marketing emails and the like does not equate to deleting/anonymising their data. Not sure how one would even think this is similar? 3. Article 17(3) of the GDPR speaks to the exceptions of the right to erasure; unless there's legitimate financial and legal means (be specific and not allusive about this), directly defaulting to these to keep the data is not a good enough reason. Wouldn't you want to reduce your organisational risks and costs, anyway? The costs to store large amounts of data, including logs and backups are astronomical. Poor data health is a real thing. There are many tools out there to help streamline these processes, including Exterro and MineOS (no, this isn't a paid ad), though firstly, understand your data infrastructure so not only your internal policies align but also so your processes are streamlined to save you valuable time. Understanding these intricacies will set you apart from other DPOs and lawyers in this field. And, if you have a great team around you like I do at BlueOptima, it is even easier to upskill yourself!
