Huge result in our class action against OSPI with a published opinion that - Ninth Circuit reversed and remanded on our denied prelimianry injunction to stop school districts from exiting student before they turn 22: As one court has observed, “[i]t is almost beyond dispute that wrongful discontinuation of a special education program to which a student is entitled subjects that student to actual irreparable harm. But the promise of compensatory education is no answer to the claim of irreparable harm arising from the denial of special education. We conclude that the students meet all four of the Winter requirements, so we vacate the district court’s order and remand for further proceedings including the entry of a preliminary injunction. We do not consider whether the proposed class warrants certification under Federal Rule of Civil Procedure 23. Because the district court has not previously addressed that issue, we leave it to be resolved on remand. VACATED and REMANDED.
Cedar Law PLLC (myself, Lara Hruska and Kaitlin Leifur-Masterson) and Susman Godfrey LLP (Ian Crosby) won a major victory in the Ninth Circuit - ordering the district court to enter a preliminary injunction against #Washington's Office of Superintendent of Public Instruction for their unlawful practice of excluding 21-year-olds from #specialeducation.

All litigants, regardless of their economic status or representation, deserve to have a verbatim record of court proceedings to ensure accountability and the ability to review legal decisions. Yet, due to a severe shortage of court reporters, over half a million family law, probate, and unlimited civil proceedings in Los Angeles County have occurred without a verbatim record during a recent 18-month span. This gap means that many litigants, especially those who are self-represented and cannot afford private court reporters, are unable to obtain a verbatim record of their proceedings. We applaud the Los Angeles Superior Court for addressing this critical problem by issuing a new General Order yesterday allowing electronic recording in these proceedings when court reporters are unavailable. This action ensures that litigants’ rights are protected, providing fairness, transparency, and access to justice for all. #AccessToJustice #CourtReporterCrisis #FairnessForAll #LASuperiorCourt

SCOTX has asked the Texas Access to Justice Commission to "examine existing rules and propose modifications that would allow qualified non-lawyers to provide limited legal services directly to low-income individuals." This is a new trend, and worth following. California is looking into similar changes. #texaslaw #practiceoflaw #unauthorizedpracticeoflaw #paraprofessional #paraprofessionals #paraprofessionalprogram #tajc #texasaccesstojustice #accesstojustice

Regarding the Texas Supreme Court's proposed Rules allowing paraprofessionals to represent clients in some legal matters: While I understand and respect the concerns many have about the potential risks to the standards of legal practice and the challenges the rules may present, I believe this initiative could be a positive step forward in providing much-needed relief to individuals who cannot afford traditional legal representation. I have read the proposed rules carefully. The matters in which paraprofessionals would be allowed to represent clients appear to be clearly defined as straightforward, non-complex and do not require intricate legal strategies or novel arguments. The rules establish appropriate training and certification requirements, including testing of the paraprofessional’s knowledge in the limited area of law in which the paraprofessional will be permitted to represent clients. As long as a clear boundary around the scope of work allowed for paraprofessionals is maintained, I believe we can improve access to legal services for those in need without compromising the integrity of our legal system.

While parties can continue to file their court documents in person at the court filing counters, the courts also have a process which allows parties to file their documents electronically. The Justice Services Online Filing Portal, also known as the JSO Portal is a portal where family law documents can be filed for a civil court proceeding. We've added a video walkthrough and downloadable tipsheet outlining the process for filing family law documents on the JSO Portal to our Family Court and Beyond website.
