2024: The Year Cryptocurrencies Take Center Stage in America No branch of the US government is leaving crypto off the table this year: The Legislature: 📑 The House of Representatives recently passed the Financial Innovation and Technology for the 21st Century Act (FIT21), which could soon become the US's first standalone legislation specific to regulating cryptocurrencies. The Judiciary: 👩⚖️ US Courts have made strides in applying the Howey test to the cryptocurrencies alleged as securities by the SEC (SEC v. Ripple Labs, Inc., et al., No. 1:20-cv-10832 (S.D.N.Y. filed Dec. 22, 2020) and SEC v. LBRY, Inc., No. 1:21-cv-00260-PB (D.N.H. filed Mar. 29, 2021). The Executive: 🤔 Politicians have wasted no time in turning cryptocurrency into a partisan issue, with US Presidential Candidate Donald Trump speaking yesterday at the #Bitcoin Conference 2024 at Nashville, Tennessee. In typical #Trump fashion, bold promises were made with vigor, and it looks like the Republican party is now on the hook to change the landscape of cryptocurrency regulation in the USA. Here's a snapshot of some of those promises: - The creation of the office for Crypto Presidential Advisory Council; - The immediate cessation of Operation Chokehold 2.0 (an informal name given to certain restrictions which obstruct crypto companies from accessing financial services); - Relieving the current SEC Chair (Gary Gensler) of his duties on Day 1 of a Trump presidency; - Enacting an executive order requiring the US Justice Department to transfer the supposed 204,000 BTC held by the Federal Reserve into a strategic reserve; - Requiring the Treasury Department to purchase 500 #BTC daily until the reserve reached at least 4 million BTC; and - Pardoning Ross Ulbricht of all convictions relating to his operation of the dark-web commerce platform Silk Road. Whether or not these promises will grow into anything more than just that, one thing is for sure: America's stance on cryptocurrencies is a hot topic this election season!
