Property owners are often told that the cost of new roof is eligible for the 30% solar tax credit. Not entirely true. Only the "incremental cost" of certain types of roofs are eligible for the tax credit. Do your homework, or engage a consultant like Solar CFO to help navigate these issues. There was a private letter ruling several years ago that introduced this concept, but I recently stumbled across similar language in the I.R.S. proposed rules defining energy property that was issued November 2023. Here is the example from the proposed regs: "A" installs solar energy property above the surface of an existing roof of a building that "A" owns. The solar energy property uses bifacial panels that convert to energy the light that strikes both the front and back of the panels if installed over a highly reflective surface that is affixed to a roof (reflective roof). The cost of the reflective roof is $15,000 whereas the cost of a standard roof for the building would be $10,000. The reflective roof does not include the portions of the existing roof that will be replaced, and any features of the roof not directly related to establishing, improving, and maintaining the efficiency of the reflective roof. Accordingly, the reflective roof, if installed in connection with the solar energy property, constitutes energy property under section 48. The incremental cost of the reflective roof is $5,000, and that amount is "A’s" eligible basis in the solar energy property for purposes of the section 48 credit. #CRE #solar
