In general, the arbitrator is an impartial person chosen by the parties. The arbitrator reads briefs and documentary evidence, hears testimony, examines evidence, and renders an opinion on liability and damages in the form of an arbitration award after the hearing. Once confirmed by a court of appropriate jurisdiction, the award can be subsequently entered as a judgment. Most arbitration is initiated by a pre-dispute contract entered into by the parties, in which they agree that if a dispute should arise, the parties shall (are required) or may, depending on the contract, elect Arbitration. The Federal Arbitration Act, coupled with the state arbitration law of the place of arbitration, generally governs the process. Many cases in Nevada require or have the option for Mediation or Arbitration before filing in court or before trial. By agreeing to arbitration (if it is not required) the parties, are waiving their right to a trial. Unless otherwise agreed, the decision is legally binding and non- appealable, except in limited circumstances. Arbitration can be “non-binding” if the parties agree however binding arbitration is far more common. . If you can arbitrate a minors claim it might be a better way to deal with claims from kids, in those states where a parent cannot sign away a minor's right to sue. Many states do not allow a parent to sign away a minor's right to sue. New Jersey is one of them. However a parent can agree to arbitrate the claims of an injured minor, even in a release that may not be valid. It is a weird quirk in the law. Arbitration is cheaper & faster and takes the burden off the court system so therefore it is encouraged in most states & by all courts. So anytime a court can encourage or support arbitration it is a good thing. Arbitration is not for every case though. Arbitration usually delivers some money to the plaintiff. Most laws covering arbitration limit or restrict the amount of money an arbitrator can award so that is helpful, especially in cases where a release is not valid. If you state supports releases and you have a solid release, you probably do not want an arbitration clause because the release stops the lawsuit.
