A Philadelphia jury awarded $14 million (in a second trial) to the family of a 4 year old boy who died after a failed intubation effort. The first trial ended in a nonsuit in in 2020 in Children's Hospital of Philadelphia favor. The sole defendant in the re-trial was #CHOP after Einstein Healthcare Network (now part of #JeffersonHealth 10/2021 merger) settled with plaintiff's during the first trial. #CHOP was found to be 66% liable in the child's death which took place at an Einstein Hospital location. While heartbreaking, this award spells more trouble for #hospitals and #providers in the #Philadelphia metro (the real Gotham City), here's why. (according to a pre-trial memo) "The child at all times was under the direct care and responsibility of the capable trained Einstein providers and the CHOP transport team never assumed care of the child, or were they obligated to assume care of the child in lieu of those experienced, trained providers in the ER" James Beazley, Jr. of the Beazley firm painted a different picture for the jury. Beazley likened Einstein's call for CHOP's help as putting out the "Bat Signal" and that instead of sending Batman, they sent Alfred. He contends, CHOP sent two pediatric nurses as the transport team, when they should have provided a pediatric specialty physician. He told the jury, the nurses "stood and watched" as the 4 year old died of suffocation. We've officially entered a new era where #hospitals and #providers can and will be found negligent, and, apportioned liability in cases where they had little to no involvement. But when their name association evokes thoughts of heroism (like CHOP does) then apparently they can be held to that standard. Quite literally in Batman fashion, jurors are led to believe that a hospital should plan, strategize and adapt to complex situations and make decisive decisions that always end in success (saving lives). My advice is that #hospitals really need be on the look out for the #Joker who represents a chaotic force that is disrupting the established order. These well funded Jokers are forcing all of us to adapt and evolve, but let's not underestimate their disruptive innovations that seem to be changing the hearts and minds of jurors. If I recall the way to beat #Joker is to anticipate his moves and use them against him. Let’s hope the Jokers actions don’t undermine the city’s faith in its #healthcareheroes

In Georgia, there are four levels of trauma centers, with Level I being the most comprehensive. Learn about the difference in each level below! 🏥 LEVEL I The center provides total care, from prevention through rehabilitation. These also offer a teaching program for medical residents, as well as ongoing research. 🏥 LEVEL Il The center is similar to a Level I trauma center but may not offer teaching or research. Levels I and Il treat both children and adults. 🏥 LEVEL III The center is smaller than Level I and Il centers, but provides prompt care to injured patients. 🏥 LEVEL IV Level IV centers provide trauma care and life support before transferring patients to a higher-level trauma center. #TraumaCare #GeorgiaTraumaCommission
