OFFICIAL: The VA published the circular announcing a temporary local variance to allow the Veteran to pay buyer’s agents charges for compensation (Circular 26-24-14). I highlighted some key points as well as shared my take a way's of the circular for education and discussion. Key Points: 1.Buyer’s Agent Compensation can’t be included/rolled in the loan amount. 2,Lenders are required to validate the Veteran has sufficient liquid assets to cover Buyer’s Agent compensation. 3.Buyer’s agent compensation must be listed on the purchase contract, AND uploaded to the VA Portal when requesting the appraisal. 4.Seller can still pay Buyer’s Agent commission. 5.If Seller pays the Buyer’s Agents Commission, this is not counted against the 4% seller concession guideline limit calc.

Performance is the essence of a contract Liquidated damages cannot be said to be a consideration received for tolerating the breach or non-performance of contract. They are rather payments for tolerating the breach of contract. Such payments do not constitute consideration for a supply and are not taxable. I. e. Forfeiture of Earnest money is stipulated in such cases not as a consideration for tolerating the breach of contract or non -performing contractual obligations but as a compensation for the losses suffered and as penalty for discouraging the non- serious buyers or bidders.

My friend Jason Rabine HSD included this statement in his recent post: "Far too often, we hear stories about brokers who lose money (or don't make enough) on a load, deduct made-up fees from carriers, or ask customers for more money." Here's my question, and it's an easy one: Why? * Why would you put yourself in a position to lose money? * Why would you deduct made-up fees from carriers? * Why would you ask customers for more money? Nobody created these issues but yourself and or a pure lack of training. This is typical of what happens in a spot market. * Why did you lose money? Because you didn't know what you were doing. * Why did you deduct made-up fees from carriers? Because you're not interested in building strong relationships. The only thing you wanted to do was to minimize the loss to maximize margins. * Why would you ask customers for more money? Because they mean nothing to you, as you figure they're here today and will be gone tomorrow because they wanted you to fill a void. So, I'll squeeze them and rake them over the coals. If I were leading these people who had these issues, I would be all over them like flys on S**t finding out why this happened. There is no acceptable excuse for any of these whys. All of these tarnish your Brand, Image, and Reputation.
