QLD: Shadesails - do they need a building development approval? A recent debate on a renovation forum involved this issue. So many contrary (and often incorrect) opinions were given, offered and debated: "It's roof isn't solid, so it doesn't need approval"...."It's got no walls, so it doesn't need approval".... "It's a temporary structure, so it doesn't need approval". If in doubt, go to the Building Regulation 2021 which lists development that is either Accepted or Exempt (Schedules 1 and 2 respectively). If the development isn't on one of these lists, it's Assessable and requires a building development approval.

Below is an update from some of my colleagues regarding the announced changes to streamline the building consent process. We definitely have work to do in New Zealand to reduce the cost and delay associated with building work, so the changes are welcome. For me, the key point is that: "...it is important the Government strikes the appropriate balance between making building easier and more affordable and ensuring that the objectives of the Building Act 2004 (specifically to ensure buildings contribute appropriately to the health of users) are appropriately provided for. It is important to remember the context in which the existing regime was developed – particularly, New Zealand’s historic problems with defective buildings."

Update on Second Staircases in High-Rise Residential Buildings: Key Points The Government has issued revised statutory guidance on 2nd staircases in new blocks of apartments above 18 meters in England. The revised guidance emphasises the need for second staircases in such buildings and clarifies that evacuation lifts will not be automatically required. Developers have 30 months from the publication of these changes to adhere to either the existing or updated guidance for new building regulations applications. After this period, all applications must comply with the new guidance. Approved applications not following the new guidance have 18 months to commence construction; otherwise, a new application must be submitted. Projects with existing planning permission for single staircases can proceed without delay, provided safety considerations were previously addressed. Local planning authorities are encouraged to take a positive and pragmatic approach to new or revised planning applications necessitated by the updated requirements, considering the potential impact on project viability.
