A recent article from Safety+Health Magazine details a re-petition from lawyers for the Occupational Safety and Health Administration to issue an emergency temporary standard protecting workers against heat exposure. In addition to providing water, rest periods, and adequate shade, it’s important to also prioritize proper PPE and helmet usage, even during the warmer months. I'm fairly certain this isn't how you're supposed to lift a snorkel lift or any other sort of AWP/MEWP, but what do I know??? I'll let my Wisconsin friend Craig Ihde chime in with his thoughts (and I'm sure they'll be more than a headshake). When Occupational Safety and Health Administration CSHO's roll into a workplace and see something like this, you can bet they are going to engage in a deep dive relative to the employer's AWP program and their crane/lifting program, among other things. If an employer allows their expensive equipment to be handled like this, how are they handling other workplace health and safety issues? But what if OSHA is provided a photo of this (or any other condition) by a disgruntled employee? Will it trigger an inspection? Can it result in citations? I posted earlier this week about a high school classmate's photo and one of you commented on how OSHA considers what is on social media as a "media referral." This photo, shared by a disgruntled employee, could also trigger an inspection, though it would be a complaint as opposed to a media referral (some of my OSHA friends can clarify if I am wrong). Having said that, can the photo standing alone, be the basis of a citation? No, probably not (Michael Rubin my Phoenix-based colleague recently wrote about this). But can it be the basis of a bunch of questions that, if answered truthfully would result in admissions that could be the basis of citations? Absolutely. I've seen it happen. We live in an age when people will watch someone die and film it before they put their devices down and render aid. Today, to expect that employees and onlookers won't document the existence of health or safety issues is an impossible dream. Since the beginning of the pandemic, 800-321-OSHA seems embedded in the directory of employee phones and complaints to OSHA have skyrocketed. Do you think these photos will be sent? I'd bet they would and I'd bet they'd be the reason OSHA start's an inspection. How does an employer prevent this? Don't let bone-headed moves like this lift happen. #odworkplacesafety #osha #awp #mewp #crane #liftingsafety
