Should non-provider entities and individuals manage medical practices? Although the answer might seem obvious, the January 2024 American Academy Of Emergency Medicine Physician Group, Inc. v. Envision Healthcare Corporation et al. lawsuit was poised to resolve that very point within California. The resulting ruling would have clarified whether California’s Corporate Practice of Medicine doctrine bars non-clinical business personnel from overseeing physician and other clinically-adjacent decisions. Indeed, the decision would have provided meaningful insight…if Envision Healthcare had only stayed in California. Envision—a larger provider group primarily led by non-clinical leadership—chose to leave California altogether before the ruling could be issued. Although Envision escaped an unfavorable fate, we predict that similar legal challenges will ensue in the future. ➡️https://lnkd.in/gHabwV-c

What doctors are able to learn during their prescribed 15 minute visits with each patient is often only the tip of the iceberg, when it comes to fully knowing the ins and outs of a patient’s life - let alone their medical history. Writing this, it almost sounds comical to think that a doctor is supposed to accurately remedy a patient’s ills in only 15 minutes while they face a computer screen and type. Yet that is just what has come to be expected of most physicians today. This NY Times article discusses a new memoir by physician Dr. Dean-David Schillinger, called Telltale Hearts. Great conference this weekend organized by Dr Mitch Li and Take Medicine Back. Dr Ming Lin was the physician hero of this conference on fighting the corporate practice of medicine. The keynote speaker, Brendan Ballou, DOJ prosecutor and author of "Plunder: Private Equity's Plan to Pillage America," led an enlightening conversation on private equity in the healthcare space and legislative steps that can be taken to protect patients and physicians. Journalists Alice Tracey from Capitol Forum and executive editor David Dayen from The American Prospect were present. David closed the conference with "Patient Zero: Medicare and the Corporate Practice of Medicine." It's clear that private equity is not done pillaging the healthcare system. Healthcare legal experts Mark Hall, Erin Fuse Brown, and Hayden Rooke-Ley gave a historical and current perspective on the corporate practice of medicine. They reviewed current and future legislative efforts on improving and introducing federal and state doctrines to curb or stop healthcare profiteering. What a dream team!
