As some of you may know, I can be a little contrarian on reading the tea leaves from SEC reports and publications. The SEC put out a #riskalert that has some pointers for #fundgovernance, but I think most boards already do the work mentioned in this alert, and mostly this is a reminder to tighten up the #recordkeeping and document #board conclusions. The #1940Act is full of picayune details and practices.

The Financial Conduct Authority (FCA) has published findings of their multi firm review on the treatment of politically exposed persons (PEPs) for anti money-laundering purposes. The review found most firms had designed systems and controls to implement the guidance but also noted issues, such as firms failing to provide a clear rationale for their risk rating. The FCA’s expectation is for all firms to refer to the review’s findings, including the good practices noted and ensure their policies, procedures and controls are in line with the guidance. Between September 2023 and July 2024, the UK's Financial Conduct Authority (FCA) reviewed firms' approaches to PEP customers to evaluate their adherence to the existing guidance.
