Today the EU Council has accepted the draft of the AI Act agreed in the Trilogue. Consumer Consumer associations such as the vzbv have stated that the compromise should be accepted despite several deficiencies. The perspective of AI providers on deficiencies will be different and my experience is that at certain point we will see class actions arise to clarify many of the requirements established in the AI act in the legally unclear language of a political compromise. One example is that the risk-based classification system will by a risky challenge for AI providers. The Act introduces comprehensive documentation requirements, cross-border supervisory cooperation, and a tiered oversight model for general-purpose AI. In this multi-layer compliance regime, a mix of regulatory interventions and private enforcement by litigation is almost pre-programmed. No doubt, the Council's decision is a milestone. The EU AI Act is landmark legislation, regulating AI based on its potential harm and including a tiered approach addressing powerful AI models, with horizontal transparency rules for all and additional obligations for models posing systemic risks. From opposition to consensus, the legislative process shows the challenges of policymaking in the digital age. As a law firm, we are engaged in mandates reflecting the AI Act's emphasis on transparency, protection of trade secrets, and the reassessment of criteria for designating AI models with systemic risks, among many other things. EU reaches provisional AI Act agreement… Lawmakers have reached a provisional agreement on the EU’s proposed #artificialintelligence Act (AI Act). The EU’s AI Act is anticipated to be the world’s first comprehensive set of rules to govern the #technology. It could serve as a benchmark for other regions looking to pass similar laws. The Act establishes obligations for “high-impact” general-purpose AI (GPAI) systems that meet certain requirements, like risk assessments, adversarial testing, incident reports, and more. It mandates transparency by those systems that include creating technical documents and “detailed summaries about the content used for training” Citizens will have a right to launch complaints about AI systems and receive explanations about decisions on “high-risk” systems that impact their rights. Fines for breaking those rules can range anywhere from €35 million or 7% of global revenue, to €7.5 million or 1.5% of global revenue of turnover. The use of AI is banned in certain applications such as: • Scraping facial images from CCTV footage. • Categorization based on “sensitive characteristics” like race, sexual orientation, religion, or political beliefs. • Emotion recognition at work or school. • The creation of “social scoring” systems. The last two are AI systems that “manipulate human behavior to circumvent their free will” or “exploit the vulnerabilities of people.” The rules include a list of safeguards and exemptions for law enforcement use of biometric systems, either in real-time or to search for evidence in recordings. A final deal is expected by year-end, but the law may not take effect until 2025. With a provisional agreement in place, additional negotiations, including votes by Parliament’s Internal Market and Civil Liberties committees, are still necessary.
