Extension of Time Line under Section 168A is Challengeable: CBIC has increased the time limit for issuance of SCN and Adjudication Order vide N.No. 56/2023 for the Year 2018-19 (up to 30 April, 2024) & 2019-20 (up to 31st August, 2024) under Section 168A. However, Section 168A provides that Extension of time can only be done in case of "Force Majeure". Further, Force Majeure is defined as case of War, Epidemic, Flood, Drought, Fire, Cyclone, Earthquake or any other calamity caused by nature or otherwise affecting the implementation of Provisions of Act. At Present, there is no calamity as such at National Level which can justify the extension of time line at National Level. if there is flood or cyclone at local level which is limited to some Jurisdiction or at max at State Level, Time Line can be extended for such Jurisdiction or State.
