A Valentines day treat for the Applicants!!! In this matter the court had to consider whether the Respondent had complied with an arbitration award or not. This application was brought by the Applicants who had been employed part-time by the Respondent as cooks, and the Respondent would call the Applicants to work once an activity requiring their services occurs in the workplace. The Applicants received R 100 per day for their services and worked for 5 days on average in a month. The Applicants were dismissed from their posts and new employees were appointed to their positions. The Applicants reffered an unfair dismissal dispute to the CCMA and the commissioner found that their dismissal was procedurally and substantively unfair and ordered the Respondent to reinstate the Applicants to their positions on the same terms and conditions before their dismissal. The Labour Court is granted powers under section 158(1)(c)of the Labour Relations Act to make an arbitration award an order of court. The court accordingly made the CCMA arbitration award an order of court. The court in reaching this decision reasoned as follows: "The ordinary meaning of the word "reinstate" is to put the employee in the same job or position he or she occupied before their dismissal. Reinstatement is aimed at placing an employee in the position he/she would have occupied but for the unfair dismissal". The Respondent in this matter had reinstated the Applicants and did not use their services for a period of 3 months meaning they were not renumerated throughout this time. The Respondent failed to comply with the arbitration award as it no longer called the Applicants to come and offer their services as and when they were required which was the position before their dismissal. In consideration of this the court made the arbitration award an order of court and ordered cost in favour of the Applicants. Chocolates and flowers for the Applicants 😊
Great day at the office and a successful outcome for clients. Now I can fully celebrate Valentines Day. #labourlaw #employmentlawyer

Do you like surprises …? As a customer … This weekend we travelled to Cleethorpes to be part of a surprise 50th Wedding Anniversary party. Ahead of the party we went for a walk along Cleethorpes seafront and as we were walking, luckily as it turns out, I spotted the couple in question walking towards us 😱😱 Quickly we turned, ran in the opposite direction and hid in a bus shelter … Ray and Colleen, walking their dog, fortunately didn’t spot us hiding and watching them stroll by. A few hours later, there were tears of joy as they walked into the garden where everyone was waiting for them to surprise them. Imagine if they’d spotted us on the seafront … the surprise would have been spoiled. This got me thinking - as a customer, do you like surprises …? I don’t think many customers like unexpected surprises as they go through their buying journey. We all like things to be made simple, so we can buy with confidence. In life, the odd nice surprise can create many happy memories; in sales, it can too, but for all the wrong reasons! So, this week, as you work with your prospects and customers, be thinking ‘what can I do to create positive experiences …’ and ‘how can I provide some nice surprises …’ When was the last time you were positively surprised as a customer …? #mbls #SalesTraining #CustomerExperience #CustomerJourney

https://lnkd.in/geVgq5pi #InsuranceStory: I went to school for Business Administration having no clue what career I wanted to pursue. One day while in the library at SUNY Oswego (which didn't happen very often! lol), I decided to look at a book that outlined different careers you could pursue with a 4-year Business Administration Degree. I came across "Insurance Underwriter" which sounded interesting. It was at that moment I decided I wanted to try and get a "leg up" by gaining some insurance experience through an internship. Not knowing the difference between an insurance carrier or agency, I decided to open the phonebook yellow pages (an actual printed book that listed all businesses by category from A-Z, lol) and solicit each insurance business asking if they'd be willing to hire a college intern for the summer. Low and behold, I received a call back from a local prominent independent agency who was willing to bring me in. I spent the summer processing personal lines policies and backing up our claims department by taking claims calls. I continued to work at the agency throughout my senior year of college and during my spring semester, I attended thirteen 8-hour Saturdays of insurance licensing classes. By the time I graduated college, I was a licensed Property Casualty Insurance Broker. I was hired by this agency as a personal-lines insurance broker after graduation, and that is how I began my insurance career! That was 30 years ago and since that time I have held various insurance roles on both the agency and carrier side of the insurance business. I have worked in personal, commercial, life, financial services and surety lines of business. Almost two years ago, I had the opportunity to join Erie Insurance Group as a Senior District Sales Manager in Central New York. I quickly learned what an amazing culture Erie exhibits and I'm SO PROUD to work for such a tremendous organization and the amazing agents that represent us!! Have you ever considered #insurance? Sick of just surviving in a job? Click below to see where you could thrive with an #insurancecareer. We are #hiring! Come join an amazing place to work! Check out Erie's career roles here: https://lnkd.in/gqf7uizR Looking for stability? Work for a company that's never had a layoff. Nope. Not one in our 99 years in business. What's your insurance story? #HappyBirthday #ERIEemployee
Today, ERIE celebrates our 99th Anniversary. While next year is a big milestone, it doesn't take away from the fact that we're proud to provide our customers with the same service today that we gave in 1925.
