What is civil litigation? ⚖️ The only form of action allowed by Federal Rule of Civil Procedure 2 ("There is one form of action--the civil action."). ⚖️ A lawsuit "commenced by filing a complaint with the [federal] court," under Federal Rule of Civil Procedure 3. What is not civil litigation? ⚖️ Suits in equity. ⚖️ Criminal lawsuits. I'm a geek for the Federal Rules, and we often skip over the introductory ones. The 2007 Amendment to Rule 2 covers the Rules' "general restyling," and the Rules Committee's effort "to make them more easily understood." Whether they succeeded at that is up for debate. In modern speak, civil litigation is filing a complaint, exchanging evidence and information (discovery), settlement negotiations or alternative dispute resolution efforts, motion practice, and trial before a judge or jury. The prevailing party is typically entitled to monetary damages, but sometimes injunctive relief (an order to do or stop doing something), or other remedies allowed by law. It covers: contract disputes, personal injury cases, property disputes, employment disputes, and consumer protection cases. A business or an individual can bring a civil action--against another business or other individual. Bradley Smith, Esq. and D. Jay Kaplan authored an article published in the Spring 2024 edition of the Pennsylvania Bar Association's Civil Litigation Update. Brad and Jay’s article addresses an area of law that does not get much attention but is becoming increasingly important. Pennsylvania, like all states, recognizes that undocumented workers can bring a claim for personal injuries when someone else is responsible. Defendants in such lawsuits will sometimes try to use the undocumented workers’ status against them by restricting the injured worker’s ability to recover lost wages. This article examines how courts across the country have handled such arguments and how Pennsylvania courts will handle them in the future, particularly in light of a new Rule of Evidence passed in 2021. Here's something that almost all litigators know and that most transactional lawyers (especially inhouse counsel) don't know. There are--at least in Florida--two types of indemnity. The first is contractual indemnity. This is what most transactional lawyers try to limit when negotiating a contract. The second is common law indemnity. Common law indemnity is when a party that is without fault seeks indemnification from another party if such liability is vicariously and solely based on the fault of the indemnifying party. So what's the point? If your contract significantly limits a party's contractual indemnity, just know that there could be an alternative way that a party seeks indemnification. Does your state recognize common law indemnity? If not, probably an even better reason to carefully select your contract's choice of law. #community #lawyer #indemnity
