The recent enactment of AB 1008 should raise significant concerns for AI developers in California, far more than the GenAI Transparency Law or other AI-related legislative measures brought about recently in the sunny state. Why? A subtle yet critical change to the definition of "Personal Information" under the CCPA/CPRA now includes data present in "artificial intelligence systems capable of outputting personal information." What does this mean in practice? It means developers and providers of LLM models and other AI systems need to be vigilant. If an AI system has been trained on personal data or processes personal information via input prompts, the entire system may be subject to CCPA/CPRA compliance requirements. The most daunting challenge? Complying with consumer rights under the CCPA/CPRA within an AI system, particularly large language models (LLMs). How can developers locate personal information embedded in tokens or model weights? How can they delete or rectify an individual’s personal data from an AI model within the mandated 90-day period without engaging in costly and practically unfeasible retraining? Furthermore, what does it mean for a "Do Not Sell or Share My Personal Information" request—does this imply the model itself cannot be sold until the consumer's data has been fully scrubbed? These questions highlight the severe technical hurdles developers face, with no clear solutions in sight. The takeaway is clear: keep personal information out of your AI models—non-compliance could become prohibitively expensive. https://lnkd.in/eeRcVNbF
