⚖️ Using Foreign Precedents to Persuade Judges Judges of a common law jurisdiction are not bound to follow decisions handed down by judges in other jurisdictions. For example, decisions of Judges in England or New Zealand are not binding on Australian judges, but they may be persuasive. Therefore, it is common for lawyers to refer to decisions from (particularly higher-level) courts in other jurisdictions when presenting their arguments to the court in an attempt to influence the judge’s decision. If a party is successful in persuading a judge to rely upon a decision from another jurisdiction, then that decision may effectively become part of common law in that country. An example of this may be seen in the New South Wales (Australia) Supreme Court’s decision in “Musumeci v. Winadell Pty Ltd (1994) 34 NSWLR 723,35” where the court decided to follow the legal principles set down in the English decision of “Williams v. Roffey Bros & Nicholls (Contractors) [1991] 1 QB 1”, thereby adopting Williams v. Roffey into the common law of New South Wales. #contractlaw #constructionlaw #law #commonlaw

#2 Have you ever heard about "collaborative negotiations”🤔 Chances are that you have not. In Belgium it is still considered a rather exotic method of amicable dispute resolution, which was only legally enshrined in 2018. How does it work? 🏀 ✅ Each party hires a lawyer whose sole mission is to help them reach a settlement.
