In Patient v. Anesthesiologist (Bay Area Sup. Ct.) Walkup, Melodia, Kelly & Schoenberger's Michael A. Kelly and Valerie Rose negotiated a seven-figure settlement on behalf of a patient who was given the wrong medication. While the patient was undergoing a routine hip replacement procedure, his anesthesiologist confused anesthesia medicine with a blood clotting agent, and inadvertently injected the blood clotting agent into the patient’s spine. As a result, the patient sustained a traumatic brain injury and a neck injury following violent seizures caused by the mistake. The defense contested the nature and extent of the brain injury, and also claimed that the neck injury was caused by prior job-related incidents.
