In Kentucky, one type of solid waste landfill is a “construction or demolition debris landfill” (CDD Landfill). These landfills are permitted to accept only waste from construction, repair, or demolition of structures and roads, as well as vegetation from land clearing. For years, state regulations have allowed CDD landfills smaller than one acre to operate without liners or leachate collection systems—both critical for preventing groundwater pollution. A new state law passed in 2024 doubles the allowable size of these unlined CDD landfills. In response, KRC submitted comments opposing regulatory changes to implement this law, challenging the legal and technical justification for permitting smaller (and now potentially two-acre) CDD landfills without the same protections—such as liners, leachate collection, and groundwater monitoring—that are required for larger landfills: https://lnkd.in/ePpnttuy

“The EPA reported finding “widespread shortcomings” in monitoring efforts at landfills, including places where methane emissions were 100 times higher than the regulatory limit” With satellite emissions tracking systems becoming more common, it’s going to get harder and harder for waste companies to hide shortcomings and noncompliance, but it looks like things are far worse than we previously could have imagined. Landfills are already considered to be the 3rd largest emitter of methane gas in the US, and methane is up to 80 times more potent than CO2 as a greenhouse gas. Now that we’re seeing how landfills are emitting far more emissions than they should be, this is a much bigger problem. I hope this bad news is more motivation for us to instead reduce waste, reuse & recycle more, and work towards ditching this outdated linear economy for a more sustainable and prosperous circular economy.

Back in May, we released a report detailing how flawed landfill management practices are driving enormous methane emissions — and how those lax practices are being perpetuated by low federal standards set by EPA. It's exciting to see EPA recognize the key role that landfill regulations play in reining in methane emissions, but the fact remains that current regulatory standards are far too low. Real estate owners beware: On July 8, 2024, the EPA’s Final Rule in the Federal Register officially designated Perfluorooctanoic Acid (PFOA) and Perfluorooctanesulfonic Acid (PFOS) as “hazardous substances” under the Comprehensive Environmental Response, Compensation & Liability Act (CERCLA). The designation of PFAS as hazardous substances under CERCLA introduces significant regulatory, financial, and operational challenges for real estate transactions. RNG landfill and manure are the same. Why is there a large difference in the intensity rating? I was told that the landfills are required by law to capture methane so they should not be rewarded with a higher selling price for doing what they are required to do by law. The dairy farmers are spending a lot of money to capture their methane and they are not required by law so they need a bigger payday. I am not sure that is fair, but we are still lower than an EV.

The dangers of asbestos go far beyond exposure during construction or renovations—improper disposal can pose serious risks to communities. Recently, Jamie Bamblett from Snodland was sentenced to 120 days in jail after pleading guilty to fly-tipping asbestos and other waste across the Sevenoaks district.
