As we continue to explore the grey area between work and home, there is a fading line between our professional and personal lives. Perhaps not a groundbreaking decision, but a sufficiently salacious tale to rank among the more memorable illustrations of that work-life boundary. This recent FWC decision explores what constitutes a clear and sufficient connection between behaviour and employment. In this case, the arena was an airport lounge. Submissions contemplate the circumstances around the lounge and a connection to employment, which raise interesting arguments that ultimately do not turn the decision. Commissioner Durham notes the employee would not have been at the airport if not required to do so to travel to work, and their entry to the lounge was inconsequential. Regardless, it is well established that the damage caused by conduct, even out of hours conduct, can be a valid reason for dismissal. The broader life lesson for frequent flyers is that the calorie club is a welcome airport convenience, but everything in moderation. https://lnkd.in/gWnkpRte
